A North Carolina Affidavit for Legal Proceedings is required when an affidavit is ordered by a court as a part of legal proceedings which involve a plaintiff and a defendant. The affidavit is a signed and sworn (or affirmed) statement, which may be requested from the plaintiff, defendant, a witness, or another interested party. The individual making a sworn statement must sign the notarial certificate in the presence of a notary public. Once the form has been completed and the individual has sworn the oath/affirmation, the notary may notarize the affidavit.
